Part 1:
General Provisions
for the Online Shop
1.1 Scope of Application
For the business relationship between Ihr Hoflieferant (Peter Hoffmann) and the customer, the following General Terms and Conditions in their English version valid at the time of the conclusion of the contract (order) apply exclusively. Deviating conditions of the customer will not be recognized unless expressly agreed to in writing.
barocktanz.com, Ihr Hoflieferant and The Brand - Fachverlag are trade names for Peter Hoffmann. Tanja Amalia Couture is the trade name for Tanja Hoffmann.
1.2 Product Safety
and Reporting Obligations
according to Regulation (EU) 2023/988 (GPSR)
The online shop primarily serves the distribution of self-published sheet music, music, dance literature, and the processing of events. We strive to comply with general product safety guidelines for all products offered. Under Regulation (EU) 2023/988 (General Product Safety Regulation), we ensure that customers can inform themselves about the safety of the products offered and report any safety-related issues immediately.
The person responsible for product safety is Peter Hoffmann. Please direct all safety-related inquiries, complaints, or reports regarding our products directly to our customer service at info@barocktanz.com or by mail to Peter Hoffmann, Helmplatz 1, 90762 Fuerth, Germany. The product range is continuously checked for compliance with statutory documentation requirements. Products for which seamless documentation cannot be guaranteed according to GPSR guidelines due to capacity reasons will be removed from the offer.
1.3 Order Process,
Offer and Acceptance
The presentation of goods and digital content in the shop constitutes an invitation to submit an offer. A binding order is placed when the "Order with obligation to pay" (Zahlungspflichtig bestellen) button is clicked during the order process. Upon receipt, the customer receives an automated order confirmation via email. This does not yet constitute an acceptance of the offer. There is no claim to the conclusion of a contract; the offer can be rejected without providing reasons.
1.4 Time of Contract Conclusion
- For physical goods: The contract is concluded upon dispatch of the shipping confirmation via email or upon delivery of the goods.
- For digital content: The contract is concluded upon downloading the file. Consumers must expressly agree prior to execution that execution will begin before the end of the withdrawal period, thereby causing the statutory right of withdrawal to expire.
1.5 Right of Use and Availability
of Digital Content
The customer is granted a simple right of use exclusively for private purposes. barocktanz.com retains all copyright and usage rights to the products and prohibits the use of the media in public performances without express written permission. Copies and printouts may not be passed on and must be collected again after use in the ensemble. The use of graphics/reproductions in publications is prohibited (for scientific purposes only upon extensive citation). Digital content is provided as a license for download or streaming for 30 days. We advise downloading and saving these immediately.
1.6 Delivery, Retention of Title
and Liability for Defects
Delivery takes place at the time stated in the product description. The products remain our property until full payment is received. The customer is entitled to statutory rights of liability for defects. Special regulations apply to entrepreneurs in accordance with § 377 HGB (German Commercial Code); here, the limitation period for claims for defects in newly manufactured items is one year from the transfer of risk. The sale of used goods to entrepreneurs is excluded from any warranty.
1.7 Limitation of Liability
barocktanz.com is fully liable for intent and gross negligence. In the case of simple negligence, liability only exists for injury to life, body, health, or an essential contractual obligation (cardinal obligation). In the latter case, liability is limited to typical and foreseeable damages. This also applies to legal representatives and vicarious agents.
1.8 Final Provisions & Jurisdiction
German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of the country in which the customer habitually resides remain unaffected. If the customer is a merchant or a public law entity, the place of jurisdiction shall be Nuremberg, Germany. We do not participate in alternative dispute resolution proceedings (Link to the ODR platform: http://ec.europa.eu/consumers/odr/).
Part 2: Special Provisions for Events
2.1 Scope of Application for Events
These specific provisions apply to all dance events, balls, picnics, dance seminars, or other events (summarized as "Events") planned, organized, and/or executed by barocktanz.com.
2.2 Registration and Participation Fee
Registration is binding for a period of 5 days upon receipt. Registrations are processed according to the date of receipt. The prices stated in the portals are total prices including all taxes. Travel, accommodation, and (unless otherwise stated) catering are not included in the participation fee. The fee is due upon receipt of the participation confirmation.
2.3 Conclusion of Contract, Right of Withdrawal,
and Cancellation of Events
- Before reaching the minimum number of participants: The statutory withdrawal period of 14 days (§ 355 BGB) applies.
- After reaching the minimum number of participants: The purchase contract is considered mutually concluded. A right of withdrawal and return no longer exists from this point onwards (§§ 312c in conjunction with 312g para. 2 no. 9 BGB). Sold admission tickets are fundamentally neither taken back nor exchanged. No replacement is provided for expired tickets.
- Order Errors: The organizer is not liable for accidental incorrect orders or double orders. The purchaser is liable themselves in the event of failure to cancel in due time.
2.4 Execution, Changes,
and Cancellations
We reserve the right to make minor changes to the schedule or a change of speaker for good cause (illness, force majeure). Such changes do not entitle the purchaser to return admission tickets.
We are entitled to cancel an event due to a low number of participants up to 14 days in advance or as a result of force majeure (e.g., extreme weather conditions, pandemics, official requirements). This also applies to indirect cancellations. If an open-air event is cancelled due to weather after more than 40 minutes of playing time, the service is deemed to have been rendered. In all cases of cancellation or termination due to force majeure, there is no entitlement to a refund of the admission price or other expenses/damages (incl. ticket fees).
2.5 Rights to Training Materials
Distributed documents, slides, images, and materials are protected by copyright. The customer is granted a simple, non-transferable right for personal use. Reproductions are prohibited.
Part 3:
Payment Providers & Terms of Payment
All prices are total prices. Any freight or delivery costs result from the product description. Additional customs duties may apply for deliveries to non-EU countries. The price is due upon conclusion of the contract.
Depending on the service, we offer the following payment options (the service providers act independently regarding data protection):
- PayPal: You will be redirected to PayPal after ordering (payment also possible without your own account).
- Advance Payment Invoice: You will receive an invoice with a 14-day payment term. Dispatch takes place after receipt of payment.
- Direct Debit: When paying by direct debit (only German bank accounts), you consent to the debit by us.
Part 4:
Cancellation Policy & Form
If the customer is a consumer, they are entitled to the following right of withdrawal (does not apply to entrepreneurs and not to events after the minimum number of participants has been reached):
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the first goods. To exercise your right of withdrawal, you must inform us (see Contact) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You will have to bear the direct cost of returning the goods.
Exclusion or Premature Expiration of the Right of Withdrawal
The right of withdrawal expires prematurely in the case of contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons (Note: Our wigs are provided with a hygiene seal. The withdrawal is excluded as soon as this seal is severed or removed).
Furthermore, the right of withdrawal does not apply to custom-made goods, unsealed audio/video recordings or software, as well as newspapers/magazines (except subscriptions).
